Trademarks
How long does a trademark take?
Often about a year from filing to registration, sometimes longer. The USPTO sets the pace; I send you an update whenever something moves.
Can I trademark a name I am not using yet?
Yes. An intent-to-use application reserves your place in line before you launch. You prove use later, before it registers.
What if someone already uses a similar name?
It depends on how similar the names are and what each of you sells. The search opinion tells you how much risk there is and what your options are.
Copyrights
Do I have a copyright without registering?
Yes. Registration adds the right to sue in federal court and, if it is timely, the chance to recover set damages and attorney fees.
Can you register a pattern or a font?
Patterns, yes. Typeface designs mostly can't be registered in the United States, though the font software can. I tell you which applies.
Working together
Do you handle patents?
No. Patents need a lawyer registered to practice before the patent office, and I refer that work to one.
Do you go to court?
I handle letters, takedowns and negotiation. If a dispute becomes a lawsuit, I help you find a litigator and hand over the file.
How do we start?
Send a few lines through the contact page. I reply within two business days with the plan I would pick and the price. Nothing is billed until we both sign.
